Deep Digest — Terms of Service

These Terms of Service ("Terms") govern your access to and use of Deep Digest, a service that generates summaries of YouTube videos and delivers them by email (the "Service"), operated by Tom Gannaway ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By signing up for Deep Digest, submitting a video or channel for summarization, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Deep Digest accepts YouTube video links or channel subscriptions and uses AI (Google's Gemini models) to generate written summaries, which are delivered to you by email. The Service is provided "as is"; we may add, change, or remove features at any time.

3. Accounts and Access

You must provide a valid email address to use the Service. During the focus-group period, access may require a shared access code; access codes are for your personal use and may not be shared or redistributed. You are responsible for all activity associated with your email address.

4. Subscription Plans and Billing

Deep Digest offers paid subscription tiers (Starter, Standard, Pro, and Power), each with different usage limits, billed monthly through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are shown at checkout and may change with notice; changes apply to future billing periods, not ones already paid for.

5. Cancellation and Refunds

Cancellation. You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period — you'll retain access to your current tier through the end of the period you've already paid for, and you won't be charged again after that.

Refunds. Payments are non-refundable, including for partial months, unused portions of a billing period, or overage charges already incurred. We may, at our discretion, issue a refund or credit on a case-by-case basis — for example, in the case of a billing error or extended service outage on our end.

6. Acceptable Use

You agree not to: use the Service to process content you don't have the right to summarize or distribute; attempt to circumvent usage limits, access codes, or billing; use the Service for any unlawful purpose; or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its underlying systems. We may suspend or terminate access for violations of this section.

7. Content and AI-Generated Summaries Disclaimer

Summaries are generated automatically by AI and may contain errors, omissions, or inaccuracies, including incorrect timestamps or misattributed claims. Summaries are provided for informational convenience only and should not be relied on as a substitute for watching the original video, especially for consequential decisions. You are responsible for verifying any information before acting on it.

8. Intellectual Property

The Deep Digest name, branding, and the Service's underlying software are our property. The original videos you submit remain the property of their respective creators; we do not claim ownership of them. Summaries generated for you are yours to use personally, but may not be resold or redistributed as a commercial product.

9. Limitation of Liability

To the fullest extent permitted by law, Deep Digest and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on an inaccurate summary or any service interruption. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify active subscribers by email before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles.
